Right of Withdrawal for Consumers

Right of Withdrawal
You have the right to withdraw from this contract within 14 days without giving any reason.
The withdrawal period is 14 days from the day,
- on which you or a third party named by you, who is not the carrier, has taken possession of the goods, provided you have ordered one or more goods as part of a single order and these are delivered together;
- on which you or a third party named by you, who is not the carrier, has taken possession of the last good, provided you have ordered several goods as part of a single order and these are delivered separately;
To exercise your right of withdrawal, you must inform us (Arno Luchmann, Goethestraße 7, 06114 Halle, Phone number: 015110423722, Email address: info@elmorio.de) of your decision to withdraw from this contract by means of a clear statement (e.g., a letter sent by post, fax, or email). You may use the attached sample withdrawal form for this purpose, but it is not mandatory.
You can also fill out and submit the sample withdrawal form or another clear statement electronically on our website (www.elmorio.de). If you make use of this option, we will promptly send you a confirmation (e.g., by email) of the receipt of such a withdrawal.
To comply with the withdrawal period, it is sufficient for you to send the notification of the exercise of the right of withdrawal before the withdrawal period has expired.
Consequences of Withdrawal
If you withdraw from this contract, we will reimburse you for all payments we have received from you, including delivery costs (except for the additional costs arising from your choice of a different type of delivery than the least expensive standard delivery offered by us), without delay and at the latest within 14 days from the day on which we received the notification of your withdrawal from this contract. For this reimbursement, we will use the same payment method that you used for the original transaction, unless something else has been expressly agreed with you; in no case will you be charged any fees for this reimbursement.
We may withhold the reimbursement until we have received the goods back or until you have provided proof that you have returned the goods, whichever is the earlier.
You must return the goods without delay and in any case no later than 14 days from the day on which you inform us of the withdrawal from this contract to us. The deadline is met if you send the goods before the period of 14 days has expired.
You bear the direct costs of returning the goods.
You only have to pay for any loss in value of the goods if this loss in value is due to handling of the goods that was not necessary for checking their nature, characteristics, and functioning.
Exclusion or Expiration Reasons
The right of withdrawal does not exist for contracts
- for the delivery of goods that are not pre-made and for which an individual choice or specification by the consumer is significant or which are clearly tailored to the personal needs of the consumer;
- for the delivery of goods that can spoil quickly or whose expiration date would be quickly exceeded;
- for the delivery of alcoholic beverages, the price of which was agreed upon at the conclusion of the contract, but which can be delivered no earlier than 30 days after the conclusion of the contract and whose current value depends on fluctuations in the market that the entrepreneur cannot influence;
- for the delivery of newspapers, magazines, or illustrated publications, except for subscription contracts.
The right of withdrawal expires prematurely for contracts
- for the delivery of sealed goods that are not suitable for return for health protection or hygiene reasons if their seal has been removed after delivery;
- for the delivery of goods if these have been inseparably mixed with other goods after delivery due to their nature;
- for the delivery of audio or video recordings or computer software in a sealed package if the seal has been removed after delivery.
